Product Use & Liability Disclaimer
1. General Use and Assumption of Risk
Raceform designs, manufactures, and supplies high-performance automotive hardware and related components intended for use in motorsports, off-road, or enthusiast applications. By purchasing, installing, or using any Raceform product, the customer acknowledges that such use may involve inherent risks to personal safety, vehicle integrity, and third-party property. Raceform makes no guarantees regarding the suitability of any product for specific applications outside of the product’s stated intended use.
The customer assumes full responsibility for evaluating the safety, legality, and compatibility of all Raceform products within the context of their vehicle, region, and application.
2. No Liability for Direct or Consequential Damages
To the fullest extent permitted by law, Raceform shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from or related to the use or misuse of its products. This includes, but is not limited to:
- Vehicle damage or failure
- Personal injury or death
- Loss of vehicle use
- Track-day or race event cancellations
- Loss of income or business
- Towing, repair, or storage fees
- Labor costs associated with installation or removal
- Legal or regulatory penalties resulting from product use
3. Installation Responsibility and Professional Use
All Raceform products must be installed by qualified professionals with experience in high-performance or motorsport vehicle systems. Raceform is not liable for damage or failure resulting from improper installation, neglect, over-tightening, under-tightening, misuse, or modifications not expressly approved by Raceform.
The purchaser is responsible for ensuring correct installation torque values, clearance, hardware compatibility, and maintenance intervals.
Raceform offers technical guidance when appropriate but does not assume the role of installer or certifier. Any deviation from supplied instructions or recommended procedures is done at the user’s own risk.
4. Custom and Bespoke Products
Raceform offers bespoke design and manufacturing services for one-off or low-volume components based on customer-provided ideas, dimensions, drawings, or performance goals. Custom parts are not subject to standard product validation or certification processes unless expressly agreed in writing.
By requesting a custom part or design, the customer:
- Accepts full responsibility for the part’s intended use
- Acknowledges that Raceform does not guarantee compliance with any local, federal, or international regulations
- Agrees that Raceform is not liable for the performance, legality, or fitness for purpose of any custom-made item
- Waives any claims relating to defects or incompatibility arising from insufficient or inaccurate specifications
5. Use on Public Roads and Legal Compliance
Unless explicitly stated, Raceform products are not certified for use on public roads and are intended for off-road or motorsport use only. It is the responsibility of the purchaser or end user to determine the legality of using any Raceform product under applicable federal, state, local, or international laws, including but not limited to:
- Department of Transportation (DOT) regulations
- Environmental Protection Agency (EPA) regulations
- TÜV, CE, or other international certification bodies
- Local vehicle inspection and modification rules
Raceform makes no representation or warranty that its products are legal for use on any public road in any jurisdiction.
6. Third-Party Use and Transfer of Products
If Raceform products are sold, transferred, or installed on a third party’s vehicle, the original purchaser agrees to disclose this liability policy to the end user. Raceform bears no responsibility for informing downstream recipients of the proper use, limitations, or risks associated with its products.
7. Product Modification, Improper Use, and Abuse
Raceform is not responsible for any damages, failures, or injuries caused by:
- Modifications to the product or its components
- Use outside of the product’s intended purpose or design
- Combination with non-Raceform components not approved for compatibility
- Environmental exposure beyond what is typical for automotive use (e.g., chemical, temperature, or impact abuse)
- Inadequate maintenance or improper torqueing
8. Limitation of Warranty Claims
Warranty coverage is limited to defects in material or workmanship under normal use and does not extend to damage caused by improper installation, misuse, off-label applications, racing incidents, or modifications. Raceform reserves the right to evaluate all claims and determine warranty eligibility on a case-by-case basis.
No warranty claim will be considered without proof of purchase and documented installation by a qualified technician.
9. Indemnification
By purchasing or using any Raceform product, the customer agrees to indemnify, defend, and hold harmless Raceform, its owners, employees, contractors, agents, and affiliates from any and all claims, demands, liabilities, damages, losses, or expenses (including legal fees) arising from product use, misuse, installation, or transfer to third parties.
10. Governing Law and Jurisdiction
This policy shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from or related to Raceform products shall be subject to the exclusive jurisdiction of the courts located within California.
11. Acceptance of Terms
By purchasing, installing, or using any Raceform product, the purchaser acknowledges full understanding of and agreement with the terms outlined in this Limitation of Liability and Product Use Disclaimer.
